Pilot Program Terms

These Pilot Program Terms supplement the Terms of Use, Privacy Policy, Research & Development Data Use Notice, and Confidentiality & Platform Access Notice. If you participate in a Project Bindr pilot or beta, these terms apply.
1. Pilot / Beta Nature
A pilot is a time-limited evaluation of an early-stage, actively developed platform. Features may be incomplete, experimental, or subject to change or removal during the pilot. The Service is provided "as is" and "as available" unless a signed agreement says otherwise.
2. Scope May Change
Pilot scope, feature availability, timelines, and supported integrations may change as the pilot progresses. We will communicate material scope changes to your designated contact.
3. Onboarding Requires Your Cooperation
Successful onboarding depends on your timely cooperation, including providing access, accurate equipment and building information, integration credentials, and a responsive point of contact. For legacy buildings without BIM models, AR and digital-twin anchoring may require additional on-site coordination.
4. Data Accuracy & Rights to Upload
You are responsible for the accuracy of the data you provide and for confirming you have the rights and authority to upload it, including documents, equipment lists, photos, floor plans, and metering data. You retain ownership of your data as described in the Terms of Use.
5. Outputs Are Decision-Support Only
Pilot outputs — including AI summaries, recommendations, readiness scores, energy insights, and warranty tracking — are decision-support tools and must be reviewed by qualified personnel before any operational decision. They do not replace professional engineering, legal, safety, or compliance advice.
6. No Guaranteed Outcomes
We do not guarantee any specific cost savings, energy savings, uptime, performance, or operational outcomes from the pilot.
7. Feedback
We may use your feedback, suggestions, and usage patterns to improve Project Bindr without obligation or compensation. Any improvements to the platform remain our intellectual property, as described in the Terms of Use.
8. Publicity & Case Studies
We will not publish case studies, use your name or logo, or reference you publicly without your prior written approval.
9. Support Expectations
During a pilot we provide reasonable, best-effort support through agreed channels. Formal service levels (SLAs) apply only where a signed agreement says so; see our Service Level Agreement for paid plans.
10. Confidentiality
Pilot materials — including non-public functionality, pricing, roadmap, prototypes, and partner or customer information — are confidential under our Confidentiality & Platform Access Notice. We will likewise keep your pilot data confidential.
11. Termination & Suspension
Either party may end a pilot on reasonable notice. We may suspend or terminate pilot access for misuse, security risk, or breach. On termination you may request export of your data within thirty (30) days, after which we may delete it subject to backups and legal retention.
12. Transition to a Paid Plan
A pilot does not automatically convert to a paid subscription. Where applicable, continued use after the pilot requires a separate paid plan or subscription on terms to be agreed.
